OK-I need some feed back from everyone here. A Merchant Market Place is opening in a very busy, high end section of our little (not really so little) town of Frisco TX. I have signed a letter of intent for a 3x10 space, which is a part of a 10x10 space. The part that I've signed for is on the outside, so has a wall on the side and the back. The merchant who had signed up for the CENTRE portion has decided to pull out. I'm being told now that I have to move to the centre so they can lease out my space to another merchant. Say What? Does this sound at all fair to anyone here? Initially, I've told her no-but I'm hating to pass up this opportunity.
Thoughts? kj

Huh??? Why can't the other merchant simply move into the center spot, since it'll empty?? I'm sooo confused? Jo

Karen, what it sounds like to me is that she has another merchant wanting to move in but will only do so for the outside space. You were there first!!

Tell her you will pull out if you can't keep the space you have and she will have to rent your space too....bet that will get her attention.

If you've signed for a space, they can't really make you move. When you say you don't want to miss out on the opportunity, do you mean to have a space at all or to have the center space?

I think Randy is right or that they know that it would be easier to rent your spot than the center spot. Also, does the letter of intent indicate what spot in the 10x10 area you intend to rent does it specify a side and back wall? If it does and you want that spot, stick to your guns. This is the business end of it and sometimes you have to be firm.
Wish you luck as it sounds like you have a something good in your grasp.

If the owner wants to weasel out of your agreement now (likely for their benefit), don’t expect that type of behaviour/treatment to improve in the future . . . regarding any aspect of the lease.
Docone has his business in a situation similar to this - maybe he'll chime in.

Sounds to me like the event coordinator either is assuming you would like the center spot, wants to bump up your fee, and feels they can fill the side spot more readily... or... has a friend that wants the side spot. That's all I can figure. Jo

Just say you are sorry but your displays are already planned for the space you had rented, that the change would cause you to have to change display designs and the cost would cut into your profit margin too greatly. Donna

Thanks for all the input everyone! This was EXACTLY my feeling as well and I didn't see that it was fair to stick me in the middle. I held my ground and she resolved her problem a different way. I'm still in my spot and she's had to work out the center part on her own. I'm really excited about this opportunity, so I hated to think about pulling out of it. We all move in on Wednesday and the soft opening is planned for Friday during the town's 4th of July event. There's an expected turnout of over 40K people all walking up and down the street right in front of the shop.
I'll take pics when I get my area set up.
Thanks again! kj
